Victim kidnapped for pack rape

Two Auckland men who kidnapped a woman for sex and participated in a pack rape have been sentenced to 15 and 16 years in jail.

Somalia-born Abdinor Abdi, 29, and Mohamed Bashir, 26, of Mt Roskill, were sentenced this morning at the High Court in Auckland after being found guilty at trial of abduction for the purpose of sex, one count of rape, three counts of being a party to rape and threatening to kill.

The Crown said Abdi and Bashir were among a group of African men who met the victim and some of her friends at the 24/7 bar on Karangahape Rd on June 4, 2011.

The 44-year-old woman got separated from her friends and as she left the bar one of the men dragged her into a car.

The men drove her to a park where one of them tried to kiss her. She tried to escape but they pushed her back into the car.

They later took her to a garage at an unknown address and four of the men raped her on a mattress, one after the other.

Crown prosecutor Sam Wimsett said the victim heard giggling coming from behind a curtain while she was being raped.

When one man was finished he would call for the next man while holding her down.

The woman said she was threatened with death if she did not dance naked in front of the group of men and she was forced to perform oral sex.

Abdi raped her twice and the other offender, Mohammed Bashir, raped her once.

The two other rapists have not been identified.

The woman’s victim impact statement said she was living in a night shelter at the time of the assault.

She had been left scared and fearful since the ordeal and she had put on 10kg.

“I have been thinking if I get fat no-one will like me and I will be safe,” she said.

She said she told her attackers she would rather be dead than what she was going through.

“I felt degraded as these guys raped me one after the other.”

She said she tried to scream but nothing came out.

Justice Ailsa Duffy said Abdi was not remorseful at all.

He had suggested he had been prosecuted because of his race and because the woman wanted a payout.

As the victim’s statement was read to the court, Abdi called from the dock: “Come on, man, she’s 45 years old.”

The judge said pack rape was viewed seriously by the courts as it involved people encouraging each other to reject normal standards of decency.

She said from what Abdi had revealed of himself in his pre-sentence report, a minimum term of imprisonment was required.

She jailed him for 16 years with a minimum non-parole period of eight years.

Bashir was sentenced to 15 years with a minimum non-parole period of 7 1/2 years.
